When allegations of sexual abuse involve a trusted medical professional, many victims are left uncertain about how to move forward. To help explain the legal paths available, we sat down with Arkansas sexual abuse lawyer Joshua Gillespie. In this interview, Gillespie discusses the steps victims can take to report abuse, the types of claims that may apply, and how hospitals could be held responsible if negligence contributed to the misconduct.

Laurence Banville, Esq.: When cases like this come to light, many victims are unsure of their legal options. What steps can someone take if they’ve been assaulted by a doctor?

Joshua Gillespie, Esq.: The first step is to contact law enforcement so an official report is made. After that, victims should reach out to an attorney who understands both the criminal and civil processes. A civil lawsuit can help hold the individual and possibly the institution accountable if negligence played a role in allowing the abuse to happen.

Banville: Are hospitals ever liable in these types of cases?

Gillespie: Yes, under certain circumstances. If there were prior complaints or warning signs that were ignored, the hospital could face legal consequences for failing to act. Each case is unique, and a detailed investigation determines where accountability lies.
