CA Attorney Explains Legal Options for Victims of Pastor Sexual Abuse
Following the recent arrest of a Compton pastor accused of sexually assaulting a child, California sexual abuse lawyer Jason Amala discusses the legal steps available to survivors. Amala, who has represented numerous victims of clergy abuse, explained how civil and criminal laws in California allow survivors to take action against both individuals and institutions that may have failed to prevent the misconduct.
Laurence Banville, Esq.: Cases like this can deeply affect entire communities. For victims of sexual abuse involving church leaders, what kinds of legal actions are available in California?
Jason Amala, Esq.: Victims have both civil and criminal options. While prosecutors bring criminal charges against the accused, survivors can also file civil lawsuits against the individual and, in some cases, the church or organization that allowed the abuse to occur.
Banville: Some survivors wait years before they feel ready to speak out. Does that affect their ability to take legal action?
Amala: California has extended its statute of limitations for childhood sexual abuse. Depending on the circumstances, many survivors can still seek damages even if the abuse happened decades ago. It’s always best to speak with a lawyer who can review the details and explain available paths forward.
