Berkeley, CA - A 19-year-old University of California, Berkeley student died following a near-drowning incident at a fraternity house off campus on Greek Row on Friday night. The student, whose name has not been disclosed, passed away after spending several days in critical condition at a hospital, according to the Berkeley Police Department announcement on Wednesday. Authorities do not suspect foul play in the death.

Police Responded to Overcrowded Party at Fraternity House

Berkeley police responded just before 11:30 p.m. Friday to reports of a male possibly drowning at the Alpha Delta Phi fraternity house located in the 2400 block of Prospect Street. When officers arrived, they found a large party with more than 300 attendees. The police noted heavy alcohol consumption and overcrowded conditions at the event.

Public Nuisance Notice Posted by Police

Within 90 minutes of the incident, police posted a public nuisance notice at the fraternity’s front entrance. The notice stated the gathering caused a disturbance of the peace and posed a threat to public safety. It warned that if another disturbance occurs on the premises within 120 days, civil penalties will be imposed.

Fraternity Statement and Known Details

Alpha Delta Phi issued a statement saying the safety and well-being of all members and guests remains their priority, but declined to provide further details due to the ongoing investigation. Students on campus have referred to the fraternity as "Aqua Delta," noting it is the only fraternity house on Greek Row with a swimming pool. Authorities continue to investigate the circumstances surrounding the incident.

Families left reeling after a drowning tragedy at a fraternity party face complex legal choices. We spoke with wrongful death lawyer Jason Amala to explain what options exist for seeking accountability and compensation when a loved one dies in such circumstances.

Laurence Banville, Esq.: When a family loses someone to a drowning at a fraternity party, what legal steps can they take?

Jason Amala, Esq.: Families may pursue claims against the fraternity or property owners if negligence played a role, such as inadequate supervision or unsafe conditions. They can seek compensation for medical bills, funeral costs, and emotional suffering.

Banville: What challenges often arise in these cases?

Amala: Proving liability can be complex because it requires showing the fraternity breached its duty of care. But gathering evidence like witness statements and party conditions is critical to building a strong case.

Banville: Are there any statutes of limitations families should be aware of?

Amala: Yes, in California, wrongful death claims usually need to be filed within two years of the fatal incident, so timely legal advice is important.
