9-Year-Old Dies in Hersheypark Wave Pool Incident; Lifeguards Responded Immediately, Park Launches Investigation

Hershey, PA – A 9-year-old child has died after a tragic incident at the wave pool in the water park section of Hersheypark in Pennsylvania, park officials said.

Swift Response from Lifeguards and Emergency Personnel

On July 24, John Lawn, CEO of Hershey Entertainment & Resorts Company, released a statement describing the immediate response from the park’s lifeguard team. The lifeguards identified a child in distress and initiated a rescue, followed by continuous coordinated life-saving efforts involving on-site first responders and medical staff. The child was taken without delay to a local hospital, where they succumbed to their injuries despite all efforts.

Wave Pool Closed in Remembrance and Respect

Park officials confirmed the incident occurred in Hersheypark’s 378,000-gallon wave pool. The pool remained closed on June 25 as a gesture of respect for the family and to honor the staff’s efforts. A spokesperson explained that more than 100 lifeguards were on duty throughout the water park at the time, including 10 assigned exclusively to the wave pool.

Certified Waterpark Staff and Safety Measures

According to the park’s spokesperson, the wave pool lifeguards had completed Special Facility Training, which covers deep water rescue, Basic Life Support, CPR, Automated External Defibrillator use, supplemental oxygen administration, and first aid. Complimentary life vests are also provided to all guests.

Reflection from Waterpark Leadership

John Lawn stated, “Our hearts break for this child and the child’s family. We extend our deepest condolences for their loss. Out of respect for their privacy, we will not release any personal details at this time.” He stressed that guest safety remains the company’s top priority and announced a thorough internal review, emphasizing full cooperation with authorities.

Drowning Risk Among Children Underscored

National statistics indicate that drowning is a leading cause of death among children ages 1 to 4, with more than 4,000 unintentional drowning deaths each year. Notably, 88% of these incidents occur when at least one adult is present, according to the National Drowning Prevention Alliance.

About Hersheypark

Founded in 1906, Hersheypark spans 121 acres and features more than 70 rides, including 15 roller coasters. The water park section, opened in 2007, houses the wave pool, a record-breaking mat racing slide, and a winding lazy river. The park remains in mourning, reflecting on the loss and reemphasizing its commitment to safety.

When a drowning occurs at a waterpark, families face not only heartbreaking loss but also complex questions about responsibility and legal rights. To clarify what steps affected families can take, we spoke with Michael Haggard, an experienced Pennsylvania lawyer who specializes in aquatic accident cases. Their conversation explores what legal avenues may be available following drownings or near-drowning incidents at waterparks.

Laurence Banville, Esq.: When incidents like the tragic death at Hersheypark occur, what legal options do families or victims have?

Michael Haggard, Esq.: Families affected by drownings or near-drownings at waterparks can explore claims based on negligence. If a park fails to provide adequate supervision, properly trained staff, or maintain safe conditions, they may be held legally responsible.

Banville: How important is the training and certification of lifeguards in these cases?

Haggard: It’s very important. If the lifeguards lacked proper training or didn’t follow safety procedures, that can strengthen a case. However, even when training is up to standard, an investigation might reveal lapses in staffing levels or emergency response.

Banville: What should families do immediately if a drowning or near-drowning happens?

Haggard: Preserve all documentation, seek immediate medical attention, and contact an experienced attorney who understands waterpark safety laws. Timely action ensures evidence is preserved and rights are protected.
