Legal Options for Victims of Sexual Abuse by Teachers in California
California law provides multiple paths for victims who have been sexually abused by a teacher, including criminal charges and civil lawsuits. In this interview, Jason Amala, an experienced sexual abuse lawyer, explores the rights available to survivors, how institutions can be held accountable, and what victims can expect when seeking justice under the law.
Laurence Banville, Esq.: When a student has been assaulted by a coach in California, what legal steps can they take next?
Jason Amala, Esq.: Victims in California have several options. They can file a civil lawsuit for damages against both the perpetrator and any institution that may have enabled or failed to prevent the abuse. California law recognizes that survivors often need time to come forward, so recent reforms have extended the statute of limitations, allowing many to seek justice even years after the abuse. It’s important for survivors to talk with an attorney soon to understand all their legal rights and possible compensation.
Banville: Are institutions like schools or sports organizations held accountable in these cases?
Amala: Absolutely. If evidence shows a school, club, or other organization knew or should have known about abuse and did not act, they can be held legally responsible. Part of what we do is investigate whether there was negligence or a cover-up, so survivors aren’t just confronting their abuser, but also addressing institutional failures that may have allowed it to happen.
Banville: What support can survivors expect as they move through the legal process?
Amala: Navigating the legal system can be overwhelming, but there are lawyers and advocates who specialize in helping survivors. From the first consultation to the resolution of their case, survivors can expect guidance, support, and a commitment to protecting their privacy wherever possible. The civil court process can not only bring compensation, but also hold wrongdoers accountable and encourage better protection for others in the future.
