Newly released records from Gillespie County provide a deeper look into the arrest of Harper ISD Assistant Band Director Pedro DeLuna III, accused of illegally recording a minor.

According to documents made public on Thursday, the full arrest affidavit was filed after DeLuna’s arrest on Monday, stemming from allegations that he recorded a 15-year-old Harper High School student without consent.

Alleged Incident After Harper Football Game

The affidavit outlines events from November 7, following a Harper High School football game. DeLuna reportedly invited the victim’s mother—and later the victim herself—to his home so that he and the mother could have "a couple of beers."

The victim’s mother accepted the invitation, and DeLuna transported the 15-year-old to his residence. The affidavit states that the mother and the victim’s sibling followed about ten minutes behind in a separate vehicle.

Victim Reportedly Changed Clothes at DeLuna’s Home

Upon reaching the residence, the victim told DeLuna she was cold and wanted to change into a different outfit she had brought along. According to investigators, what happened next forms the basis of the charges filed against the band director.

Further details contained in the affidavit describe recorded video evidence allegedly obtained during this visit. Authorities have not released the full contents of that evidence, but confirmed that it supports the charge of illegal recording of a minor.

Investigation and Administrative Response

Law enforcement confirmed that DeLuna was taken into custody earlier this week and booked into the Gillespie County Jail. Harper ISD officials have not yet announced disciplinary actions, but stated they are cooperating fully with ongoing investigations.

The case remains active as Gillespie County investigators continue reviewing digital evidence connected to the alleged crime.

As communities process allegations involving educators and student victims, questions often emerge about how families can respond legally. Attorney Laurence Banville spoke with Texas sexual abuse lawyer Anjali Nigam to discuss the steps victims and parents can take when a teacher crosses professional lines. Nigam explained how early legal action can protect victims, preserve evidence, and hold both individuals and school systems accountable for misconduct.

Laurence Banville: When allegations like this involve a teacher or school employee, what steps can families take to protect their child and pursue legal action?

Anjali Nigam, Esq.: The first priority should always be ensuring the student’s safety, which may mean reporting the incident directly to law enforcement and the Texas Department of Family and Protective Services. From a legal standpoint, families may also have civil claims against both the individual and, in some cases, the school district if negligence played a role in allowing the misconduct to occur.

Banville: How soon should parents consult with an attorney after an arrest like this?

Nigam: As soon as possible. Early legal guidance helps preserve evidence and ensure compliance with reporting requirements. Time limits apply in both criminal and civil proceedings, so quick action can make a difference in the outcome.

Banville: What message would you share with parents concerned about potential abuse in schools?

Nigam: Pay attention to changes in behavior, ask direct questions, and encourage open communication. No teacher or staff member should ever cross professional boundaries. When they do, families have every right to demand accountability.
