Miami, FL — A 33-year-old therapist at a women’s mental health and substance abuse treatment center in Miami faces multiple sexual misconduct allegations from patients, Miami police confirmed Tuesday.
Victims Report Threats and Sexual Assault During Therapy Sessions
Manuel Enrique Garcia was apprehended by the Miami Police Department’s Felony Apprehension Team on July 15. He worked at a facility located on NE 49th Street. Investigators say the case began after two female patients came forward with disturbing claims. One woman, in her late 40s, said Garcia physically violated her and threatened her with job loss and homelessness if she spoke out. Another victim, a woman in her mid-20s, recounted being coerced into sexual acts under threats that her therapy records would be altered, potentially preventing her from reunifying with her child.
Third Victim Emerges With Additional Allegations of Abuse During Therapy
Newly released arrest documents reveal a third patient alleging that in January, Garcia locked his office door, subjected her to inappropriate comments, and forced her into sexual acts. This claim resulted in extra charges being filed against him.
Other Residents Corroborate Similar Experiences
Police confirmed that statements from the three victims were supported by reports from other female residents of the facility who described similar misconduct by Garcia.
Currently, Garcia remains in custody at Turner Guilford Knight Correctional Center. He is scheduled to appear in court this Thursday.
Authorities are urging anyone else with information or additional victims to contact the Miami Police Special Victims Unit immediately.
Understanding Legal Options for Victims of Therapist Abuse
In light of the allegation, we sat with Florida sexual abuse lawyer Michael Haggard to discuss the paths available for patients who have faced abuse by a therapist. Their conversation covers the challenges survivors may face, the legal actions they can take, and the importance of timely support and representation.
Attorney Laurence Banville: When patients are sexually assaulted by someone in a position of trust, like a therapist, what legal paths can they take?
Attorney Michael Haggard: Victims have several options. They can file a criminal complaint that may lead to charges and prosecution, as in this Miami case. Additionally, they can pursue a civil lawsuit seeking damages for the harm caused. Both routes aim to hold the offender accountable and help the victims recover.
Banville: Are there challenges victims should be aware of in these cases?
Haggard: Unfortunately, yes. Proving misconduct can be complicated, especially when incidents occur behind closed doors. Documentation, witness statements, and any evidence of coercion or threats play a vital role. Support from professionals experienced in these matters can make a big difference.
Banville: What advice would you give to anyone who believes they might have been abused in a therapeutic setting?
Haggard: Speak up as soon as possible and reach out to authorities or legal counsel. Early action can preserve evidence and open doors to justice and healing. No one should feel they have to face this alone.
