Legal Options for Victims of Massage Abuse
When a trusted professional violates a patient’s boundaries, the path forward can feel overwhelming. We spoke with Arkansas sexual abuse lawyer Joshua Gillespie to explore what legal actions victims of sexual assault by a masseuse can take, highlighting the support and recourse available to those affected.
Laurence Banville, Esq.: When a patient experiences sexual assault during a massage, what legal steps are typically available to them?
Joshua Gillespie, Esq.: The first step is to report the assault to law enforcement so the criminal process can begin. Victims can pursue criminal charges against the perpetrator, such as rape or sexual assault. Beyond criminal prosecution, they may also have grounds for a civil lawsuit seeking damages for the harm caused.
Banville: Are there specific challenges patients might face in these cases?
Gillespie: Yes, these matters can be sensitive and emotionally difficult, and proving what happened might rely heavily on testimony and any available evidence. However, patient rights and protections remain strong, and the law recognizes the trauma involved.
Banville: What support can victims expect during this process?
Gillespie: Victims often receive assistance from advocates, counseling services, and qualified attorneys who guide them through both legal proceedings and healing. It’s important that survivors understand they have options and resources to help them move forward.
