San Ysidro, CA – Nearly nine months after a parent’s report prompted an internal investigation, a former instructional aide at Sunset Preschool in San Ysidro is now facing two criminal counts involving a young child at the facility.
A complaint filed Friday names 23-year-old Jaime Godinez, accused of committing lewd acts with a preschooler on January 15. Officials said Godinez was immediately removed from campus and placed on leave the following day as law enforcement began its investigation.
Accused Preschool Assistant’s Arrest and District Response
According to the San Ysidro School District, Godinez was arrested on July 23 and remains on unpaid administrative leave as termination proceedings move forward.
“Our district has strict safety protocols in place, including fingerprinting, background checks, and mandatory safety training,” the district said in a statement. “We take this matter very seriously and remain unwavering in our responsibility to protect every student.”
Facility Report and Evidence Findings
An inspection report filed with the California Health and Human Services Agency on August 29 detailed findings that contributed to Godinez’s arrest. The agency’s analyst cited a forensic interview, inconsistencies in Godinez’s statements, and lab results showing evidence inside the child’s garment. The report concluded that “the preponderance of evidence standard has been met to support the personal rights violation.”
Employment Timeline
The district stated that Godinez began as a classified substitute on March 23, 2022. Over time, he worked as an instructional aide for online learning, later joining the Smythe Child Development Center before transferring to Sunset Preschool last year.
Parents Express Outrage Amid Sexual Abuse Allegations
Roxane Palestino, whose daughters previously attended Smythe, said she worries about other children. “How many more students were affected? It’s been three years, and now this comes forward,” Palestino said.
She criticized the district’s transparency. “They just don’t tell us anything. He was given too much trust.”
The preschool serves children between the ages of 3 and 5, making it difficult for investigators to gather direct testimony.
District Notification Following Teacher Assistant’s Arrest for Sexual Abuse of Preschooler
In a parent notice dated October 6, the district confirmed Godinez passed federal and state background checks before hiring and has not been on campus since January 15. Termination proceedings are ongoing.
Legal Actions Families Can Take After Abuse by a Teacher’s Assistant
In the aftermath of serious abuse allegations involving a teacher’s assistant, questions often arise about how families can hold those responsible accountable. Jason Amala, a California lawyer experienced in child abuse cases, explains the legal steps available to parents and victims. Their discussion focuses on the difference between criminal prosecution and civil remedies, and what families can do to protect their children’s rights while seeking accountability from schools and staff.
Laurence Banville, Esq.: When a case like this arises in a preschool setting, what legal paths are open to families?
Jason Amala, Esq.: Families can pursue both criminal and civil action. The criminal case, managed by the district attorney, addresses punishment and public safety. Separately, families often file civil claims against the school district or its employees if negligence allowed the abuse to happen.
Banville: Does a cleared background check limit a district’s liability?
Amala: Not necessarily. If there were supervision lapses or ignored warning signs, the district may still face liability. Civil suits often focus on whether proper monitoring and reporting procedures were followed.
Banville: What should parents do if they suspect misconduct?
Amala: They should document concerns, contact law enforcement immediately, and seek legal representation. An attorney can ensure both the child’s rights and emotional well-being are protected throughout the process.
