Chicago, IL – The Archdiocese of Chicago announced on September 6, 2024, that a state investigation is underway into alleged sexual abuse by a newly ordained priest. Father Martin Nyberg, 28, is facing accusations of child exploitation and molestation during a public penance service.

Catholic Church Addresses Allegations of Priest Sexual Abuse

In letters to St. Josaphat Parish in Chicago and St. Paul of the Cross Parish in Park Ridge, Cardinal Blase J. Cupich revealed that the Illinois Department of Children and Family Services (DCFS) is investigating the allegations against Father Nyberg. The cardinal stated that Father Nyberg “strenuously denies the allegations”.

Accused Priest’s Background and Current Status

Father Nyberg was ordained in May 2024 and began serving as associate pastor at St. Josaphat Parish on July 1, 2024. Prior to this, he served as a deacon at St. Paul of the Cross Parish from June 2023 through May 2024.

Cardinal Cupich has asked Father Nyberg to step aside from his ministry while the investigation is ongoing. The Archdiocese will await recommendations from their Independent Review Board following the completion of the civil authorities’ investigation.

Child Sex Abuse Allegations During Catholic Retreat and Parent Response

Local news reports indicate that parents met with St. Josaphat School representatives on September 5 regarding allegations made by their children. These allegations stem from an eighth-grade confirmation retreat in August, where Father Nyberg allegedly asked inappropriate sexual questions during confession and was reported to have “inappropriately touched” several students.

Archdiocese’s Response to Accusations of Sexual Abuse Against Newly Ordained Priest

The Archdiocese of Chicago has reported the allegations to civil authorities and offered assistance to the accusers, in accordance with their policies. A spokeswoman for the Archdiocese stated that the case is being handled according to their policies and that they will inform the public of the outcomes.

Broader Context of Church Sexual Abuse

This case emerges in the wake of a comprehensive report released by the Illinois Attorney General’s office in May 2023. The report documented approximately 2,000 cases of child sex abuse by Catholic clergy and religious brothers across all six Illinois dioceses over almost 70 years, starting in 1950.

As the investigation unfolds, the Archdiocese encourages anyone who feels they have been sexually abused by a priest, deacon, religious or lay employee to come forward. The case underscores the ongoing challenges faced by the Catholic Church in addressing and preventing sexual abuse within its ranks.

Legal Options for Clergy Abuse Victims

The recent allegations of sexual abuse against a Catholic priest have once again brought the issue of clergy misconduct to the forefront. As the Archdiocese of Chicago faces scrutiny, many are left wondering about the legal options available to victims and the potential consequences for negligent institutions. To address these pressing questions, we spoke with Erv Nevitt, a seasoned sexual abuse attorney in Illinois. In this interview, Nevitt offers valuable information on the legal rights of victims, the process of holding religious organizations accountable, and the challenges faced by those who come forward with allegations of abuse. His insights provide a clear picture of the legal landscape surrounding clergy sexual abuse cases and offer guidance for those seeking redress.

Laurence Banville, Esq.: What legal options do victims sexually abused by a priest have?

Erv Nevitt, Esq.: Victims can file civil lawsuits against the priest and the Archdiocese of Chicago. These suits may seek compensation for emotional trauma, therapy costs, and other damages resulting from the abuse. Additionally, victims can report the abuse to law enforcement, potentially leading to criminal charges.

Banville: How can victims hold the Archdiocese accountable?

Nevitt: The Archdiocese can be held liable if it’s proven they were negligent in supervising the priest or failed to act on prior knowledge of misconduct. Lawsuits can compel the Archdiocese to disclose records and implement stricter safeguards. Public pressure from legal action often prompts institutional changes.

Banville: What challenges might victims face when coming forward?

Nevitt: Victims often grapple with emotional and psychological hurdles, including fear, shame, and trauma. Legally, statutes of limitations can be an obstacle, though recent changes have extended filing deadlines in many jurisdictions. Support from experienced clergy abuse lawyers can be crucial for victims navigating these challenges.
