Child Sex Abuse Attorney Shares Legal Guidance for Gymnastics Abuse Survivors
The recent allegations against former gymnastics coach Lance Spencer have brought attention to the serious issue of child sexual abuse in sports. As the legal proceedings unfold, many families may find themselves grappling with questions about their rights and options. To address these concerns, we spoke with Jesse Forbes, a seasoned West Virginia attorney specializing in child sexual abuse cases. In this interview, Forbes offers valuable information on the legal avenues available to survivors and their families, as well as strategies for holding negligent parties accountable. His insights provide a roadmap for those seeking to navigate the complex legal landscape surrounding these sensitive cases.
Laurence Banville, Esq.: Mr. Forbes, what legal options are available for children who have been sexually abused by gymnastics coaches?
Jesse Forbes, Esq.: Survivors have several avenues for legal recourse. They can pursue criminal charges against the abuser, as well as civil lawsuits against the coach, the gym, and potentially other organizations that failed to protect them. These civil cases can seek compensation for medical expenses, therapy costs, and emotional trauma.
Banville: How can negligent parties be held accountable in these situations?
Forbes: Gyms, schools, and sports organizations have a duty of care to protect the children under their supervision. If they failed to conduct proper background checks, ignored warning signs, or didn’t implement adequate safeguards, they can be held liable. This might involve proving negligent hiring practices, insufficient training, or a lack of proper policies and procedures.
Banville: What advice would you give to families affected by such abuse?
Forbes: My primary advice is to report any suspicions or incidents to law enforcement immediately. Then, consult with an experienced attorney who specializes in child sexual abuse cases. These cases are complex and emotionally challenging, so it’s important to have knowledgeable legal support. Additionally, ensure the child receives appropriate counseling and support services.
