Irvine, CA – A 79-year-old Irvine doctor is at the center of a civil lawsuit filed by 15 women claiming sexual abuse during medical examinations. Dr. John Carl Hoefs, along with Hoag Memorial Hospital Presbyterian, UC Regents, and the Liver Specialty Center, were named as defendants in the legal action filed on Thursday.
Allegations of Sexual Misconduct by Hepatologist
The lawsuit alleges that Dr. Hoefs, a hepatologist, exploited his position to sexually abuse, assault, and harass his patients. One plaintiff, identified as “Jane Doe 1,” reported the doctor’s behavior to the California Medical Board in October 2017, but no action was taken.
According to the legal complaint, Dr. Hoefs took advantage of patients’ lack of knowledge about proper hepatology examinations to engage in inappropriate touching for his own sexual gratification.
Criminal Charges Against Dr. Hoefs
The lawsuit stated that Dr. Hoefs intentionally had patients disrobe and molested them during treatments without medical justification. The attorney described the doctor as a “predator”.
Dr. Hoefs was arrested on May 3 and faces charges of sexual battery by fraud. He was released on a $500,000 bond and could face over 20 years in prison if convicted.
Institutional Responsibility Amid Doctor Sexual Abuse Lawsuit
The lawsuit also claims that staff at the medical facilities failed to stop or report Dr. Hoefs’ alleged sexual abuse. Attorney Stewart mentioned known reports to the medical board and other physicians about the doctor’s inappropriate behavior.
Hoag Hospital stated that Dr. Hoefs operated an independent practice from leased space and was not employed by the hospital. The hospital expressed dismay at the allegations and condemned the alleged abuse.
Ongoing Investigation After Patients Accuse Doctor of Sexual Assault During Exams
The Orange County District Attorney’s Office believes there may be additional victims and encourages them to come forward. As the case unfolds, it highlights the critical issue of patient safety and the responsibility of medical institutions to address misconduct allegations promptly.
Legal Recourse for Victims of Medical Sexual Abuse
The recent allegations against an Irvine physician have brought the issue of sexual abuse in medical settings to the forefront of public attention. As more victims come forward, questions arise about the legal options available to those who have experienced such trauma. To address these concerns, we spoke with Jason Amala, a seasoned California sexual abuse lawyer. In this interview, Jason Amala offers valuable information on the rights of victims, the process of holding both individual perpetrators and institutions accountable, and the importance of timely action for those affected by medical sexual abuse. His insights provide a roadmap for survivors navigating the complex legal landscape surrounding these sensitive cases.
Laurence Banville, Esq.: What legal options do victims have in cases of sexual abuse by doctors?
Jason Amala, Esq.: Victims can pursue both criminal and civil cases. While criminal charges aim to punish the offender, civil lawsuits allow survivors to seek compensation for damages. These lawsuits can target not only the abusive doctor but also institutions that may have enabled or failed to prevent the abuse.
Banville: How can hospitals be held accountable in these situations?
Amala: Hospitals can be held liable if they negligently hired, retained, or supervised the doctor. This includes ignoring complaints, failing to investigate allegations, or not implementing proper safeguards. Victims can sue hospitals for negligence, which can lead to significant settlements or verdicts.
Banville: What advice would you give to potential victims in this case?
Amala: I urge any potential victims to come forward and speak with law enforcement or an experienced attorney. There are often time limits for filing claims, so acting promptly is important. Remember, you’re not alone, and there are legal protections in place to support you through this process.
