Legal Recourse for Teacher Sexual Abuse Victims: Child Sexual Abuse Attorney Speaks Out
The recent arrest of former Itasca ISD coach Adrian Buruato on charges of sexual assault involving a student has brought the issue of teacher-student sexual abuse into sharp focus. As communities grapple with the aftermath of such incidents, many wonder about the legal options available to survivors. To address these concerns, we spoke with Anjali Nigam, a seasoned Texas sexual assault attorney. In this interview, Nigam offers valuable guidance on the legal avenues open to those who have experienced sexual abuse at the hands of an educator, explaining the potential for both criminal prosecution and civil litigation. Her insights provide a roadmap for survivors and their families as they navigate the complex legal landscape surrounding these deeply troubling cases.
Laurence Banville, Esq.: Ms. Nigam, what legal options are available for students who have been sexually assaulted by a teacher?
Anjali Nigam, Esq.: Survivors of teacher sexual assault have several legal avenues. They can pursue criminal charges, which the state will prosecute. Additionally, they can file civil lawsuits against the perpetrator and potentially the school district for negligence.
Banville: Can you elaborate on the potential claims against the school district?
Nigam: Certainly. Schools have a duty to protect students. If they failed to properly screen the teacher during hiring, ignored warning signs, or didn’t respond appropriately to complaints, they could be held liable for negligent hiring, retention, or supervision.
Banville: What kind of compensation might be available in these cases?
Nigam: Survivors may be entitled to damages for medical expenses, therapy costs, pain and suffering, and emotional distress. In some cases, punitive damages may also be awarded to punish particularly egregious conduct.
Banville: How does the age of the student affect these cases?
Nigam: In Texas, any sexual relationship between a teacher and student is illegal, regardless of the student’s age. Even if the student is 18 or older, it’s still a second-degree felony punishable by up to 20 years in prison.
Banville: What advice would you give to survivors and their families?
Nigam: I urge them to seek legal counsel promptly. An experienced attorney can help protect their rights, guide them through the legal process, and ensure all responsible parties are held accountable.
