Martinsville, IN – Brittany Fortinberry, a 31-year-old former substitute teacher for Martinsville Schools in Indiana, is now confronting additional charges related to the alleged sexual abuse of several students. The case has taken a disturbing turn as more survivors have come forward, revealing shocking details about the alleged misconduct.

Expanding Investigation Uncovers More Victims

Initially charged in October 2023 with three counts of sexual misconduct with a minor, Fortinberry now faces a total of 24 new charges. These include 10 counts of child molestation, eight counts of dissemination of matter harmful to minors, five counts of contributing to the delinquency of a minor, and one count of sexual misconduct with a minor.

The investigation, which began on August 22, 2024, has uncovered a pattern of alleged abuse spanning multiple schools where Fortinberry taught, including Eminence High School, located at 6760 IN-42, Martinsville, IN 46151.

Former Teacher Faces New Charges in Student Abuse Case

Court documents filed on March 14 in Morgan Superior Court reveal alarming accusations from multiple survivors:

  • Drug Use and Exploitation: Victims claim Fortinberry supplied them with drugs, including “shrooms, weed, and alcohol,” making it difficult for them to recall events.
  • Explicit Content: Fortinberry allegedly sent explicit videos to minors, including footage of herself using sex toys and engaging in sexual activities with other men.
  • Forced Participation: Some students reported being forced to watch Fortinberry engage in intercourse with other underage victims.
  • Financial Coercion: Fortinberry allegedly paid hundreds of dollars to students in exchange for photos of their genitals.
  • Threats and Manipulation: Victims stated that Fortinberry threatened to kill herself if they reported her actions to authorities or parents.

A Betrayal of Trust

A woman who considered herself Fortinberry’s friend since 2022 reported noticing strange behavior around her children, including buying expensive gifts and contacting them on Snapchat after being told to stop.

The case continues to unfold as investigators work to uncover the full extent of the alleged abuse. Fortinberry, who resigned from her teaching position on January 9, 2024, remains in custody as the legal process moves forward.

Legal Pathways for Teacher Abuse Survivors: Expert Attorney Speaks Out

The recent allegations against former Indiana teacher Brittany Fortinberry have sent shockwaves through the community, leaving many wondering about the legal options available to survivors of such abuse. To address these concerns, we sat down with Jeff Gibson, a seasoned Indiana school abuse attorney at Wagner Reese. Gibson offers valuable guidance on the complex legal landscape facing those who have experienced sexual abuse at the hands of an educator. From criminal proceedings to civil lawsuits, Gibson outlines the potential avenues for accountability and healing. His professional perspective provides a roadmap for survivors and their families as they navigate the challenging journey ahead.

Laurence Banville, Esq.: Jeff, what legal recourse do these victims have?

Jeff Gibson, Esq.: The survivors have several potential legal avenues. They can pursue criminal charges, which are already underway. Additionally, they may file civil lawsuits against the perpetrator and potentially the school district if negligence can be proven.

Banville: How might the school district be held accountable?

Gibson: If it can be shown that the school failed to properly vet Fortinberry, ignored warning signs, or didn’t have adequate safeguards in place, they could be liable. This could include failure to conduct thorough background checks or to respond appropriately to any prior complaints.

Banville: What challenges do these cases typically face?

Gibson: These cases can be emotionally taxing for survivors. There’s also the challenge of gathering evidence, especially when drugs were allegedly involved. However, with multiple victims coming forward, their collective testimonies strengthen the case.

Banville: What advice would you give to the victims and their families?

Gibson: Seek professional counseling and support. Document everything you can remember. Contact an experienced attorney who specializes in school abuse cases. They can guide you through the legal process and help protect your rights.
