Understanding Legal Rights in School Abuse Cases

In recent times, cases of abuse within educational settings have raised significant concerns about student safety and institutional accountability. To explore the legal avenues available to victims and the responsibilities of schools, Mike Haggard, a seasoned lawyer specializing in child sexual abuse cases provided valuable information on the rights of students affected by such incidents and the legal measures that can be taken against negligent school systems.

Laurence Banville, Esq.: Thank you for joining us, Mr. Haggard. In cases where a school psychologist is involved in child abuse and exploitation, what legal rights do the affected students have?

Mike Haggard, Esq.: Victimized students have the right to seek justice through civil lawsuits against the perpetrator. These lawsuits can aim to recover damages for the emotional and physical harm suffered. Additionally, they can cover costs related to therapy and other necessary treatments.

Banville: How can schools be held responsible if they fail to protect students?

Haggard: Schools can be held liable if they were negligent in their duty to safeguard students. This includes failing to conduct proper background checks or ignoring warning signs of inappropriate behavior. Victims can file claims against the school district for not taking adequate measures to prevent such incidents.

Banville: What steps should victims take if they are considering legal action?

Haggard: It’s important for victims to consult with an attorney who specializes in abuse cases. An experienced lawyer can provide guidance on the legal process, help gather evidence, and ensure that the victims’ rights are protected throughout the proceedings.
