Legal Recourse for Victims of School Sexual Assault: An Expert’s Perspective

The recent arrest of Brandon Duran, a teaching assistant at the California School for the Deaf, on charges of multiple sexual assaults has brought the issue of student safety in educational institutions to the forefront. As communities grapple with the aftermath of such incidents, questions arise about the legal rights of victims and the accountability of schools. To address these concerns, we spoke with Jason Amala, a seasoned attorney specializing in cases involving sexual abuse in educational settings. In this interview, Amala offers valuable information on the legal options available to victims and explains how negligent schools can be held responsible for failing to protect their students.

Laurence Banville, Esq.: Thank you for joining us. In cases where students have been sexually assaulted by a teacher or teaching assistant, what legal rights do the victims have?

Jason Amala, Esq.: Victims of sexual assault by a teacher have several legal avenues available to them. They can file a civil lawsuit against the perpetrator for damages related to the assault. Additionally, if the school failed to provide a safe environment or ignored warning signs, the institution itself can also be held liable. This is particularly true if the school did not conduct proper background checks or failed to act on previous complaints against the teacher.

Banville: How can victims ensure that schools are held accountable for negligence in these situations?

Amala: Schools have a duty to provide a safe learning environment. If they breach this duty, victims can pursue a negligence claim against the school. This involves proving that the school knew or should have known about the risk and failed to take appropriate action. Successful claims can result in the school being held financially responsible for the victim’s damages. It’s important for victims to work with experienced legal counsel to navigate these complex cases and to ensure all responsible parties are held accountable.

Banville: What steps should victims take if they believe their school has been negligent?

Amala: Victims should document everything related to the incident and any prior complaints that were made to the school. It’s also crucial to report the incident to law enforcement and seek legal advice as soon as possible. An attorney experienced in handling such cases can help gather evidence, file the necessary claims, and advocate for the victim’s rights throughout the legal process.

Banville: Thank you for your insights. Your expertise is invaluable for those navigating these difficult situations.
