Civil Lawsuits for Victims of Restaurant Shootings

In the aftermath of a tragic shooting incident at a restaurant, victims and their families often find themselves grappling with the physical, emotional, and financial aftermath. To uncover the legal options available to gun violence victims, Attorney Laurence Banville sits down with personal injury attorney Jeff Gibson, Esq., who is experienced in handling cases involving violent crimes in Indiana. In this exclusive interview, Attorney Gibson shares his knowledge on pursuing civil lawsuits, seeking justice, and obtaining compensation for victims injured or killed in restaurant shootings.

Laurence Banville: Thank you for joining us, Jeff.

Jeff Gibson: Thank you for having me, Laurence. It’s a pleasure to be here.

Laurence Banville: Jeff, in light of the recent shooting at the Waffle House in Indianapolis, victims and families may be wondering what options are available in terms of seeking justice and compensation. Can you shed some light on this matter?

Jeff Gibson: Absolutely, Laurence. When individuals are injured or killed in a shooting incident, they may have the option to pursue a civil lawsuit against those responsible. In cases like this, victims and their families may be entitled to compensation for a range of damages, including medical expenses, pain and suffering, lost wages, and even wrongful death claims.

Laurence Banville: That’s certainly a significant aspect, Jeff. Could you explain the types of parties who could potentially be held accountable in such cases?

Jeff Gibson: Certainly, Laurence. In shooting incidents at establishments like a restaurant, various parties may be held accountable depending on the circumstances. This could include the shooter themselves if identified and apprehended. Additionally, if there was negligence or inadequate security on the part of the restaurant, they may also bear responsibility. In some cases, if alcohol was involved and the shooter was visibly intoxicated, the establishment that served them alcohol may be held liable as well.

Laurence Banville: That’s an important point to consider, Jeff. What would be the first steps for victims or their families contemplating a civil lawsuit?

Jeff Gibson: The first step would be to consult with an experienced personal injury attorney who specializes in violent crimes. They can evaluate the case, gather evidence, and guide the victims or their families through the legal process. It’s crucial to act promptly, as there may be time limitations for filing a lawsuit, depending on the jurisdiction.

Laurence Banville: Excellent advice, Jeff. Lastly, any final thoughts or recommendations you would like to share with victims?

Jeff Gibson: Yes, Laurence. It’s important for victims and their families to remember that they are not alone in their journey for justice. Seeking legal representation can provide them with the support and guidance needed during this challenging time. Additionally, by holding those accountable through civil litigation, victims can not only seek compensation but also raise awareness about the need for improved safety measures to prevent such tragic incidents from occurring in the future.

Laurence Banville: Thank you, Jeff, for your valuable insights and guidance on this matter.

Jeff Gibson: My pleasure, Laurence. Thank you for having me.
