Laurence Banville, Esq. (LB): Thank you for joining us, Brian. Given your experience in handling cases of child sexual abuse, could you provide some insights into what options are available for victims who have suffered abuse by a school teacher?

Brian Kent, Esq. (BK): Certainly, Laurence. Victims of sexual abuse by school teachers may have legal recourse through civil cases against the liable parties involved. These cases aim to hold the responsible individuals, as well as the institutions accountable for their negligence or failure to protect the students.

LB: What would be the first step for a victim considering filing a civil case?

BK: The first step is for the victim to consult with an experienced sexual abuse attorney who specializes in these types of cases. They can provide guidance on the legal options available and help determine the strength of the case. It’s important for victims to seek legal assistance promptly to ensure their rights are protected.

LB: What factors are considered when assessing the viability of a civil case against liable parties?

BK: Several factors come into play. First, the age of the victim at the time of the abuse is significant, as there may be different statutes of limitations depending on the jurisdiction. Additionally, evidence such as witness testimonies, documents, and any available surveillance footage can play a crucial role in establishing liability.

LB: Are there any challenges victims might face in pursuing civil cases against school institutions?

BK: Yes, there can be challenges. Schools and educational institutions may try to protect their reputation or deny any knowledge of the abuse. Gathering evidence and proving negligence on their part can be complex. However, with the right legal representation and a thorough investigation, victims can seek justice and hold these institutions accountable for their actions or inaction.

LB: Thank you, Brian, for providing us with valuable insights into this important topic. Victims of sexual abuse need to understand that they have legal options available to seek justice and compensation for the damages they have suffered.

BK: Absolutely, Laurence. It’s important for victims to know that they are not alone and that there are legal professionals ready to advocate for them. Our firm is dedicated to helping survivors of sexual abuse and fighting for their rights.
