Laurence Banville, Esq. (LB): Brian, thank you for joining us.

Brian Kent, Esq. (BK): Thank you, Laurence. It’s my pleasure to be here.

LB: Given the recent incident where the after-school aide was charged with child sex abuse, I wanted to discuss what victims of sexual abuse during after-school programs can do in terms of pursuing a civil case against those responsible. What are their options?

BK: Victims of sexual abuse during after-school programs have legal recourse to seek justice and compensation through civil litigation. It’s essential for them to consult with an experienced attorney who specializes in sexual abuse cases. We can help victims understand their rights and guide them through the legal process.

LB: What parties can be held liable in such cases?

BK: In these types of cases, several parties may potentially be held liable for the sexual abuse. This can include the perpetrator, the organization running the afterschool program, the school district, and even individuals who were aware of the abuse but failed to take appropriate action to prevent it. Each case is unique, and liability depends on the specific circumstances involved.

LB: How can pursuing a civil case help victims of sexual abuse?

BK: Pursuing a civil case can serve multiple purposes for victims. First, it provides them with a platform to hold the responsible parties accountable for their actions. It can also help victims obtain financial compensation for the physical, emotional, and psychological damages they have suffered. Additionally, a civil case may contribute to preventing similar incidents from occurring in the future by shining a light on any systemic failures or negligence.

LB: What challenges might victims face when pursuing a civil case against liable parties?

BK: Victims of sexual abuse may face various challenges when pursuing a civil case. These can include reliving the trauma during the legal process, potential intimidation or pressure from defendants, and navigating complex legal procedures. However, with the support of an experienced attorney, victims can receive the guidance, protection, and advocacy they need to navigate these challenges effectively.

LB: What guidance would you give to victims who are considering pursuing a civil case?

BK: My primary recommendation would be to prioritize their well-being and safety first. It’s crucial for victims to seek proper counseling and support throughout the healing process. Secondly, I would strongly encourage them to consult with a skilled sexual abuse attorney who can provide personalized guidance based on their unique circumstances. An attorney can help them understand their legal options, assess the strength of their case, and advocate for their rights.

LB: Thank you, Brian, for helping us understand this important topic and providing valuable insights for victims of sexual abuse during after-school programs.

BK: You’re welcome, Laurence. It’s crucial that victims know they are not alone and that there are legal avenues available to seek justice and support their healing process.
